Terms & Conditions of Sale – White Frame Store

- General information
These Terms & Conditions (“Terms”) govern all purchases made through White Frame Store / www.whiteframestore.com. By placing an order, you agree to be bound by these Terms. Please read them carefully before making a purchase.
- Products
We sell original artwork/canvas as described in each product listing. Colors may vary slightly due to the differences in screen displays. All product descriptions, images, and prices are provided in good faith.
- Pricing & Payment
All prices are listed in EUR, inclusive or exclusive of VAT (as stated on the checkout page). Payment must be fulfilled before the order is confirmed and shipped. We accept payment by accepted payment methods: credit/debit card
- Shipping & Delivery
All orders are processed and delivered on weekdays (Monday-Friday, excluding holidays). Orders placed on Saturdays and Sundays will not be processed until the following Monday.
The Seller is not responsible for unforeseeable delays, provided that, except in cases of force majeure, the Products will be delivered within a maximum period of 30 (thirty) days starting from the day after the Customer placed the order, unless the Seller notifies the Customer within the same period of the subsequent unavailability, even temporary, of the ordered products.
We are not obliged to find the correct address for the delivery. If we were not provided with the correct address, and there are multiple residents on that address, we will use reasonable endeavours to deliver, but cannot guarantee the delivery of the products to the correct recipient. Shipping costs and estimated delivery times are displayed at checkout. We will use all reasonable efforts to ensure that the products are delivered within the estimated timeframe but shall not have any liability towards you if the products are delivered later.
Non-Deliverable Items: If an order is returned to the sender due to an incorrect address or refusal by the recipient, the products will be destroyed without refund or replacement.
- Order cancellation & Return policy
Orders cannot be cancelled or modified once sent to production, including changes to shipping addresses. See our contact page for assistance.
Production Timeline: Average production time for orders within EU is 2 days
Delivery Timeline: Orders arrive on average 3-5 weekdays after shipment, but delivery times may vary based on the destination.
No Returns Policy: All products are made to order and cannot be returned once produced.
- Damaged or faulty items
Any item that doesn’t arrive in perfect condition, either from a flaw in printing or physical damage, will be replaced immediately at no cost or hassle to you. There are NO restocking or return shipping fees to replace your prints due to our error. We will never require you to mail your order back to us for returns or exchanges.
If there are defects discovered, such as damage to the delivered products, errors in the number or quantity of the delivered products or lack of quality of the delivered product, you should provide us with photographic or other documentary evidence of the existence of a defective product. If we have not received from you a complaint in writing within 48 hours of delivery, we shall have no liability for any defect.
7. Copyright
The website, including all its content, is owned by White Frame Gallery or its licensors and is protected under intellectual property and marketing laws. This extensive protection means that elements such as trademarks, company names, product names, images, graphics, design, layout and information about products, services and all other content may not be copied or used in any way without the written authorization of White Frame Gallery.
8. Processing of Personal Data (Privacy)
The Personal Data provided or acquired will be subject to Processing based on the principles of fairness, lawfulness, transparency, and protection of privacy pursuant to current regulations. The Seller, as the Data Controller, processes the Users' Personal Data by adopting appropriate security measures aimed at preventing unauthorized access, disclosure, modification, or destruction of Personal Data. The Processing is carried out using IT and/or telematic tools, with organizational methods and logic strictly related to the indicated purposes. The User's Data is collected for the execution of pre-contractual measures; to fulfill obligations arising from the concluded contract; for the registration procedure aimed at purchasing Products; to follow up on specific requests made to the Controller by the User; for sending information and promotional and commercial offers also through the newsletter service based on the freely given consent of the User; for soft spam purposes for promotional communications concerning the purchased Products without the need for the User's prior and explicit consent, as provided by art. 130, paragraph 4, of the Privacy Code as amended by Legislative Decree no. 101 of 2018. Therefore, the Customer is invited to carefully read the information on the processing of personal data (Privacy Policy) provided pursuant to EU Regulation 679/2016, as well as on the use of cookies with the related consent to processing where required (Cookie Policy).
9. Changes to the general conditions
White Frame Store reserves the right to revise these terms of use at any time. Any changes to the terms and conditions will be published on our website. The revised terms and conditions will take effect when you accept them (when making a new purchase or visiting the website), or alternatively after a period of 30 days from when White Frame Store informs you of the changes. In order to be well informed of any changes to the terms and conditions, we recommend that you visit our website regularly.
10. Applicable law and competent court
These Terms and Conditions are governed by Italian law. In case of disputes arising from the validity, interpretation, execution, and termination of contracts concluded online, the following provisions apply:
For the Consumer Customer: Any dispute that may arise between the Consumer Customer and the Seller regarding contracts concluded online shall be subject to the jurisdiction of the judge of the place of residence or domicile of the Consumer, in accordance with the current legal provisions on consumer protection (so-called consumer forum).
For the Professional Customer: Any dispute that may arise between the Professional Customer and the Seller regarding contracts concluded online shall be subject to the exclusive jurisdiction of the Court of Barcelona.
